Welcome to Oozezi.com. These Terms and Conditions (“Terms”) govern your relationship with Oozezi Creative Collective. By accessing our platform, participating in the Fan-Written Fiction project, or hiring our design agency, you agree to these terms.

1. Purpose and Scope

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Oozezi Creative Collective (“the Company,” “we,” “us”) and any individual or entity accessing the website oozezi.com (“the User,” “you”). These Terms govern your use of the writing platform, participation in competitions, and engagement with our digital design agency.

2. Age Restriction & Content Advisory

The Platform is strictly restricted to individuals aged 18 years or older. By creating an account, you represent and warrant that you meet this age requirement. The Platform may host literary content involving mature themes, complex social commentary, or artistic depictions unsuitable for minors. The Company disclaims all liability for access by minors in violation of this clause.

3. Intellectual Property (IP) Rights

User Content (The Writer’s Platform): You retain the full copyright to any original literary work submitted to the Platform. However, by submitting a piece (for challenges or general publication), you grant the Company a non-exclusive, worldwide, perpetual, royalty-free license to host, display, distribute, and promote your work on our digital channels.

Agency Work (Design Clients): Ownership of intellectual property for design deliverables (logos, UI/UX, branding) remains with the Company until Final Payment is received in full. Upon receipt of full payment, the Company assigns the copyright of the Final Deliverables to the Client, retaining only the right to display the work in our professional portfolio.

Trademarks: “Oozezi,” the Oozezi logo, and all related branding are protected trademarks of the Company. Unauthorized use is strictly prohibited.

4. Artificial Intelligence (AI) and Originality

Competition Ban: All entries for “Gold” or prize-bearing challenges must be the product of human creativity. The use of Generative AI (e.g., ChatGPT) to draft, refine, or structure competition entries is a breach of contract and results in immediate disqualification and a permanent ban.

Editorial Discretion: The Company may, at its sole discretion, publish AI-generated content for purely entertainment or experimental purposes, provided such content is clearly labeled.

5. Competition Rules and Prize Disbursement

Verification: Winners must undergo a verification process. While a government-issued ID is not mandatory, you must provide a Formal Identification (e.g., Student/Work ID) that satisfies our compliance team. Failure to provide verification within 7 days of request results in prize forfeiture.

Judging Finality: Judging is subjective. All decisions made by the Oozezi panel are final and non-appealable.

6. Service Fees & Debt Recovery

Agency Plans: Revisions are strictly limited to the number of rounds specified in your selected plan. Additional revisions will be billed at an hourly rate.

Late Fees: All invoices are due within the timeframe stated on the invoice. Any invoice remaining unpaid 7 days past the due date shall automatically incur a 5% late surcharge. Continued non-payment may lead to service suspension and referral to a debt recovery agency.

7. Limitation of Liability and Indemnification

The Company provides the Platform “as is.” We are not liable for any indirect, incidental, or consequential damages (including loss of data or profit). You agree to indemnify and hold the Company harmless from any 3rd-party claims arising from your breach of these Terms (e.g., a writer submitting a story they didn’t actually write).

8. Dispute Resolution

In the event of a dispute, parties agree to first attempt an amicable settlement. If unresolved within 30 days, the dispute shall be referred to Mediation at the Lagos Multi-Door Courthouse (LMDC) or governed by the Arbitration and Mediation Act 2023 of Nigeria.
